EU Adviser Rules In Favor of German Library

European Union magistrate Maciej Szpunar issued an advisory opinion stating that the digital cultural library run by Preussischer Kulturbesitz (the Prussian Cultural Heritage Foundation) does not violate copyright laws.


Courthouse News reporter Cain Burdeau writes that European Union magistrate Maciej Szpunar issued an advisory opinion stating that the digital cultural library run by Preussischer Kulturbesitz (the Prussian Cultural Heritage Foundation) does not violate copyright laws. At issue was the Foundation's use of thumbnails and links to works at participating institutions, such as museums. Szpunar said that embedding these works does not require the consent of the author and cannot be deemed a new form of communication with the public. The opinion gives key legal guidance but is not binding on the court.
