Netherlands: ruling on second hand e-book platform

The Amsterdam Court of Appeal has overturned an earlier judgement and decided that Tom Kabinet – a second hand e-book platform – should temporarily cease selling e-books.

The ruling states that Tom Kabinet cannot currently prove that sellers had acquired the e-books legally.  The company sells second hand e-books at a much lower price than the standard fee for 'new' e-books.  It plans to adjust the business model and remove items for sale which might violate the order.
